A USA Notary is allowed to notarize paper-based or electric documents. But on both cases the presence of the signer before the notary is imperative. In fact, without the presence of the signer, the notarial act cannot commence. The notary must be able to assess the signer’s identification, understanding of the transaction and free will in signing the document.
USA Notary basic duties may differ from state to state. The common and most basic duties of a USA Notary in all states include performing oaths/affirmations and acknowledgments, signature witnessing and attesting to photocopies of certain documents. Some states also include solemnizing of marriage as part of a USA Notary’s basic duties. It is required of a notary to fully understand and honor the state laws that govern his/her practice.
